West pleaded guilty in October to misdescribing the house and was fined £950

Wooh there. He needs to refund the money and any cost incurred too.

Good point. How does the doctrine of adverse possession affect the situation?

It looks as if the householders in the terrace have exercised use of it for a lot longer than 12 years.

Exactly. Best tactic would have been to keep quiet and just use it, eventually they would have been granted possession. Presumably that fence was already in place, all they had to do was prove that it had been there for the designated time (presumably they can include time used by the previous owner). Now having highlighted it, they are fucked.

I used to live next to a farmer's field in a row of houses, the farmer was absent pretty much i.e. he just whored out the land to tenant farmers who didn't really care much either way. Over time the dodgier neighbours started expanding their gardens into the field, maybe only 1ft a year but after a while it became really noticeable.

Don't know if that's what happened here but it wouldn't surprise me - imagine having the gall to take over someone else's land, it's not much better than being a dirty fucking pikey.

 

Up the road, they backed onto woodland and looking at it now, some of them really took the complete piss:
