What about the mobile phone of the driver? Surely, assuming he had one, it would show him in that area at the same time.

It is disccused over on this forum - not that anything interesting is said other than disgust at no prosecution.

It's a bit bizarre, if Parking Eye snaps your car not paying sufficient to park they can harrass you for fines without any concern about who was driving, assuming it was the owner unless you can prove otherwise.

There is something wrong with vehicular crime convictions (or lack of) in the UK. Everything from driving like a total dick up to actually killing someone as a result of the former seems to lead to some random, arbitrary sentencing that bears no relation to the seriousness of the offense.

I thought that was the case now ,as the owner is legally responsible for knowing who are driving the vehicle  

IIRC it was changed to close a loophole in speeding fines ,as before the owner only had to name the driver once they had done that they had "complied to the law"

the catch was it was then down to the police to prove the named person was not driving the vehicle at the time (basically find an empty house make up a name and it was them driving now you prove differently )...it worked then but now if they draw a blank  the owner gets the points and a fine the only plus point is that fine and points are standard fines and points three points and fixed penalty fine
